2ndAppeal/complaint received on : 20.02.2024 Information sought and background of the case:

The Appellant filed an RTI application dated 15.09.2023 seeking information on following points:-

“Hence, I wants Complete information about how to file suit in Central Government Industrial Tribunal, Dhanbad ie (i) Is there any form to file. suit in Central "Government Industrial Tribunal, Dhanbad.

• any fee to file suit in CGIT Cum (ii) Is there any Labour Court, Dhanbad, Thart (hand.

(iii) Is there any annexures in the form of format to be attached to file seit in CGIT, Dhanbad. of format to the in reply. Kindly provide Copy of (iv) Is there any rides Conferencing method to hearing in CCIT Cum Labour be used for hearing Court, Dhanbad, Kharkhand because I am from Monghyr and it takes time and money to travel Dhanbad.

(V) To defend this suit in Tribunal on my own. Hence I wants information from Central public information officer, CGIT Cum Labour Court, Dhanbad, Is there any prohibition to defend this suit on my own.”

Aggrieved with non-receipt of any reply from the CPIO within time limit, the Appellant filed a First Appeal dated 15.10.2023 which was not adjudicated by the FAA.

Aggrieved and dissatisfied, the Appellant approached the Commission with the instant Second Appeal.

Facts emerging in Course of Hearing:

Appellant: Present Respondent: Shri Upendera Kumar, I/C Secretary to the Court The CPIO vide written submission dated 18.3.2025 stated that information sought for by Mrityunjay Kumar has already been furnished by this office vide letter No. LCT 44/2025/228, dated 17.03.2025. Further it is informed that regular post of Secretary to the Court/CPIO, CGIT No.2, Dhanbad has superannuated on 31.12.2023. In the meantime only 3 M.T.S. (Peon) has been working. Thereafter, the post of Secretary to the Court/CPIO is vacant upto 15.02.2024. The work of Secretary to the Court/CPIO, CGIT No.2, Dhanbad was assigned to Secretary to the Court/CPIO, CGIT No.1, Dhanbad as dual charge of both CGIT's, CPIO in charge held to provide information on time inadvertently. Hence, delay caused is deeply regretted with not to repeat such mistake in future.

Decision:

Upon the perusal of the case records & submission, the Commission observes that an appropriate reply has been provided by the CPIO. No further action lies.

The Appeal stands disposed off.
