1. The Appellant filed an RTI application dated 14.12.2024 seeking information on

the following points:

2. The CPIO replied vide letter dated 08.01.2025 and the same is reproduced as under

Reply Parawise reply are as under-

Point No. 1 and 3- The information is already available in public domain for

public. You may visit MCA website Le. www.mca.gov.in.

Point No. 2 CIN and DINs of the respective registered companies and their

signatories are available in the public domain. In this regard You may visit MCA

website i.e. www.mca.gov.in.

Mobile No. and email of the directors is a third party information which are

exempted to disclose under section 8(1)(j) of the RTI Act 2005.

3. Dissatisfied with the response received from the CPIO, the Appellant filed a First

Appeal dated 22.01.2025 alleging that the information provided was incomplete, false

and misleading. The FAA vide order dated 05.02.2025 observed as under:-

Reply In reference to your appeal dated 22.01.2025 in respect of your RTI

application dated 14.12.2024 and CPIO's reply dated 08.01.2025. In this

connection it is stated that the CPIO has informed you as per the RTI Act, 2005.

Further, if you so desire you may visit the MCA website www.mcs.gov.in under the

provisions of section 399 on payment of the prescribed fee where you may inspect

the document file of the company/ get information already available in public

domain as a part of the service given to all the stakeholders by the Ministry of

Corporate Affairs on its website www.mca.gov.in. Please note that the information

which is available in public domain cannot be treated as information held by or

accessible under section 2(j) of RTI Act, 2005. The appeal thus stands disposed of

accordingly.

4. Aggrieved and dissatisfied, the Appellant approached the Commission with the

instant Second Appeal dated 24.02.2025.

5. The Appellant inter alia submitted that the relevant information has not been

provided by the PIO till date. He averred that the PIO had stated in the reply that the

information sought is in public domain, however, the information sought was not found

there.

6. The Respondent while defending their case inter alia submitted that the relevant

information as the Appellant may visit the MCA website www.mcs.gov.in under the

provisions of section 399 on payment of the prescribed fee where he may inspect the

document file of the company/ get information already available in public domain as a

part of the service given to all the stakeholders by the Ministry of Corporate Affairs on
