Information sought and background of the case

The Appellant filed an RTI application dated 10.12.2024 seeking

information on the following points:

“Under the provisions of the Right to Information Act, 2005, I request

the following information:

1) A copy of the letter issued by the Indian Banks Association (IBA)

with reference number HR&IR/MISC/KSC/SBI/2760 dated

17.05.2017, concerning fitment in anomaly, as referred to in SBI

Circular No. CDO/P&HRD-PM/15/2017-18, Sl. No. 211/2017-18.

2) A copy of the communication, correspondence, or letter(s) sent by

SBI to the IBA that prompted or referred to the above-mentioned IBA

clarification letter.

This information pertains to policy clarifications and decisions

affecting employees, making it a matter of public interest. I believe the

requested information is not exempt under any provision of the RTI

Act and should be disclosed in the interest of transparency.”

The CPIO replied vide letter dated 07.01.2025 and the same is reproduced

as under:-

“1. The letter по. HR&IR/MISC/KSC/SBI/2760 dated 17.05.2017 has

not been issued by this Public Authority, hence this is not under

control of this Authority.

Therefore, it does not fall under the definition of information u/s 2(f)

of RTI Act.2005.

2. The information sought being is exempted from disclosure u/s

8(1)(d) of the RTI Act 2005 as it is in nature of commercial confidence

of the Bank.

Moreover, no public interest warrant disclosure of the same.”

Dissatisfied with the response received from the CPIO, the Appellant filed

a First Appeal dated 08.01.2025. The FAA vide order dated 29.01.2025

stated as under:-

“I have examined the appeal submitted by the appellant and also

perused all the relevant documents placed before me including the

application submitted by the Appellant, Reply sent by the CPIO &

DGM (P&PMD) and First Appeal preferred by Appellant

It is observed that the CPIO has denied the information sought in

query No. 1 invoking section 2(f) of RTI Act 2005 as referred letter

has not issued by the public authority and hence does not fall under

the definition of "information". In my view, only such information is

required to be supplied under the RTI Act which already exists and is

held by the public authority or held under the control of the public

authority.

Further, it is observed that the CPIO has denied the information

sought at query No. 2 under section 8(1)(d) of RTI Act 2005 as the

information sought is in the nature of Commercial Confidence of the

Bank and no larger public interest warrants disclosure of the same. In

my view, the CPIO has acted as per the provisions of the RTI Act,

2005.

In view of the above, I do not find any merit in the first appeal and

therefore dismiss the same. The decision of the CPIO & DGM

(P&PMD) is upheld.
