1. The Appellant filed an RTI application dated 01.12.2024 seeking information on

the following points:

4) List of Names of Directors

2. Contractual Employees.etc.

2. The CPIO replied vide letter dated 02.12.2024 and the same is reproduced as under

:-

Reply:-regarding query 1 to 6: Date of Incorporation, Certificate, Memorandum

of Association, Articles of Association, Directors/Members (DIR 11/12), Branch

address Annual Returns and Balance sheet (AOC4/23ACA,MGT7) etc can be seen

by taking online inspection of Documents filed by the company.

You are requested to take online documents filed electronically after June, 2006

onwards, please go to the tab View required Public Documents for verifying the

documents. Please go through the procedure for viewing public documents on

MCA website. CPIO further adds that information sought by the applicant, can be

obtained by taking online inspection of the company from MCA Website.i.e.

www.mca.gov.in by taking inspection of the same with respect to sought

information, if filed. Applicant need to LOGIN/REGISTER and Click on View

Public documents on payment of prescribed fee. Information already available in

public domain is not required to be provided..etc.

3. Dissatisfied with the response received from the CPIO, the Appellant filed a First

Appeal dated 16.12.2024 alleging that the information provided was incomplete, false

and misleading. The FAA vide order dated 17.12.2024 upheld the reply given by the

CPIO.

4. Aggrieved and dissatisfied, the Appellant approached the Commission with the

instant Second Appeal dated 02.12.2024.

Facts emerging in Course of Hearing:

Appellant: Not present

Respondent: Ms. Garima Nagpal, AROC- participated in the hearing through video-

conference.

5. The Respondent while defending their case inter alia submitted that relevant

information as per the provision of the RTI Act has been duly provided to the

Appellant. She added that information sought by the applicant, can be obtained by taking

online inspection of the company from MCA Website .i.e. www.mca.gov.in by taking

inspection of the same with respect to sought information/documents, if filed by the

company. A written submission dated 10.04.2026 has been received from the CPIO and

same has been taken on record for perusal. The relevant extract whereof is as under:

“..C. The reply given by CPIO in original RTI application is true & correct

for point no. 1 to 5. Such information is available in public domain & can

be obtained by taking on online inspection of the MCA website.

Directors, details available in online inspection of the company from MCA

to LOGIN/REGISTER then enter CIN of t
