The Appellant filed an RTI application dated 29.09.2024 seeking copies and documents submitted by the directors for the following companies during registration:-
01. “Skyline City Construction LLP, CIN No. AAL-8176, Address: 301 ARENJA ARCADE PLOT NO 4 SECTOR-17 VASHI NA NAVI MUMBAI Thane Maharashtra
400705, 02. ANTELOPE CONSTRUCTIONS LLP, CIN No. AAL-8177 Address: 301 ARENJA ARCADE PLOT NO 4, SECTOR-17 VASHI NAVI MUMBAI Thane MH 400705 IN Thane Maharashtra, INDIA.”
The CPIO, Registrar of Companies, Mumbai vide letter dated 10.10.2023 replied as under:-
“Reply: regarding documents submitted by company can be seen by taking online inspection of the records filed by the company.
For online documents filed electronically after June, 2006 onwards, please go to the tab View required Public Documents for verifying the documents. Please go through the procedure for viewing public documents on MCA website. CPIO further adds that information sought by the applicant, can be obtained by taking online inspection of the company from MCA Website .i.e. www.mca.gov.in by taking inspection of the same with respect to sought information, if filed. Applicant need to LOGIN/REGISTER and Click on View Public documents on payment of prescribed fee. Information already available in public domain is not required to be provided.
Please go to the tab View Public Documents for verifying the documents and use the tab Get Certified Copies for applying for certified copies of the required documents. Please go through the procedure for viewing public documents on MCA website.
Further it is stated that CIC in order in Appeal No. CIC/AT/A/2007/00112 dated 12.04.2007 has already held that once certain information is placed in public domain accessible to the citizen either freely or on payment of a predetermined price, that information cannot be said to be held or under the control of the public authority and thus would cease to be an information accessible under the RTI Act
2005.”
Dissatisfied with the response received from the CPIO, the Appellant filed a First Appeal dated 10.10.2023. The FAA vide order dated 12.10.2023 upheld the reply of CPIO.
Aggrieved and dissatisfied, the Appellant approached the Commission with the instant Second Appeal.
Facts emerging in Course of Hearing:
A written submission dated 29.04.2025 has been received from the Appellant stating his grievance on being denied personal hearing by the First Appellate Authority.
The Respondent from ROC, Mumbai has also submitted written submission dated
25.04.2025 reiterating the response sent to the Appellant.
Hearing was scheduled after giving prior notice to both the parties.
Appellant: Not present Respondent: Shri Agja Pranav Kumar Govindbhai – CPIO, ROC, Mumbai was present through video conference during hearing.
The Respondent stated that information in terms of the available records and as permissible under the RTI Act, had been duly furnished to the Appellant.
Decision:
Perusal of records of the instant case reveals that the Respondent had furnished appropriate response based on information available on records, in terms of the provisions of the Act. Considering the fact that the response of the PIO is legally appropriate and well within the precincts of the RTI Act, no further intervention is warranted in this case, und
