1. The Appellant filed an RTI application dated 31.08.2023 (offline) seeking the following information:

“NOTE-I: In Final Order dated 05.08.2023, JMIC Bharat under his signature held that "There is dispute between the parties regarding the occurrence taken place from 04:00 p.m. to 06:00 p.m. on 23.2.2017 at Ajanta Society. The relevant CCTV footage was already taken by the IO vide recovery memo on 5.7.2017, copy of which is Ex. C-3". Further JMIC Bharat under his signature held that "two number of cameras were working out of which one camera was working at the main gate and other camera was working inside the office of the society. Since JMIC Bharat made said claims CONTRARY to judicial record:

A. I be supplied Certified copy of recovery memo on 5.7.2017, whereby relevant CCTV cameras footage regarding the occurrence taken place from 04:00 p.m. to 06:00 p.m. on 23.02.2017 at Ajanta Society was seized by IO, as claimed by JMIC Bharat under his signature in above said final order.

B. I be supplied Certified copy of Seizure Memo, whereby CCTV cameras footage of working camera inside OFFICE ROOM of society was seized by IO, as claimed by JMIC Bharat under his signature in above said final order.

D. Start Time of CCTV footages of OFFICE ROOM.

E. End Time of CCTV footages of OFFICE ROOM.

F. Camera Number of CCTV footages of OFFICE ROOM.

G. Exhibit number of Certificate U/S 65-B of Evidence Act dated 09.05.2017, wherein P.C. Singal, Ajanta Society president certified that ALL CCTV cameras were working properly on 23.02.2017.

H. Exhibit number of Seizure Memo dated 09.05.2017, whereby IO Jasbir Singh seized Two CDs containing CCTV footages of MAIN-GATE and MEETING dated 23.02.2017 from P.C. Singal, Ajanta Society President.

I. I be informed Duration, Start Time, End Time and Camera Number of CCTV footages of MAIN-GATE.

J. I be informed Duration, Start Time, End Time and Camera Number of CCTV footages of MEETING.

K. I be informed (Digital Video Recorder) DVR Serial number wherefrom above CCTV footages was seized.

L. I be informed (Hard Disk Drive) HDD Serial number wherefrom above CCTV footages was seized.

M. I be informed number of channels, number of cameras connected and recording capacity of above DVR and HDD, wherefrom above CCTV footages was seized.

NOTE-II: Vide C.I.C. order dated 08.04.2019 Ex.C-6 directed supervisory IO/DSP(Crime)/ CPIO as: "Commission directs CPIO to provide complete information... to appellant, after procuring the same from the concerned COURT along-with Digital File Size of Relevant Time of TWO functional CCTV cameras, free of cost...

N. I be supplied Documentary PROOF whereby DSP(Crime)/CPIO procured CCTV camera footages of MAIN-GATE and MEETING dated 23.02.2017 of relevant time of 04:00 p.m. to 06:00 p.m. (TWO hours footage each)

from the Court in-compliance of said CIC directions.

O. If "Reply to above is 'NO proof" I be supplied CCTV camera footages dated 23.02.2017 of MAIN-GATE and MEETING of relevant time period of 04:00p.m. to 06:00p.m. on judicial record of this Court, as stated by JMIC Bharat under his signature in above said order.
