RTI application filed on : 31.08.2023 CPIO replied on : 21.09.2023 First appeal filed on : 30.09.2023 First Appellate Authority’s order : 21.10.2023 2nd Appeal/Complaint dated : 17.01.2024 Information sought:

1. The Appellant filed an RTI application dated 31.08.2023 (offline) seeking the following information:

“NOTE-I: In Final Order dated 05.08.2023, JMIC Bharat under his signature held that "one camera was working in OFFICE ROOM and one camera was working at the main gate on the date of alleged concurrence from 04:00 PM to 06:00 PM on 23.2.2017 and the same fact came in the investigation of the police."

Since JMIC Bharat made said claims CONTRARY to judicial record:

(4) Following Documents/ Information be supplied:

A. I be supplied Certified copy of Seizure Memo, whereby CCTV footage of working camera inside OFFICE ROOM of society was seized by IO, as claimed by JMIC Bharat under his signature in above said final order.

B. I be informed Duration, Start Time, End Time and Camera Number of CCTV footages of OFFICE ROOM of society.

C. I be supplied certified copy of Documentary Proof PRIOR to 25.09.2017 wherein said fact that "one camera was working in OFFICE ROOM" came in investigation by police, which stands CONCLUDED on 25.09.2017, with submission of Final investigation reports u/s 173 Cr. P.C., by IO in Trial Court (PCH/3319/2017 and PCH/3320/2017) wherein Challan there is absolutely NO Whisper, NO Mention and NOT even a hint that any CCTV camera was installed inside the office room of society.

D. I be also supplied List of documents attached with Final reports u/s 173 Cr.P.C. submitted on 25.09.2017, duly mentioning above documentary proof on point above.

NOTE-II: In Final Order dated 05.08.2023, JMIC Bharat under his signature held that "From perusal of these documents, it transpires that the IO has only taken the video CD from P.C.Singal regarding the alleged occurrence from the MAIN GATE and the MEETING point which was given by P.C.Singal being president of the society who has handed over the certificate u/s 65B and suffered the statement u/s 161 Cr.P.C. before the police."

E. I be informed Duration, Start Time, End Time and Camera Number of CCTV footages of MAIN-GATE.

F. I be informed Duration, Start Time, End Time and Camera Number of CCTV footages of MEETING.

G. I be informed (Digital Video Recorder) DVR Serial number wherefrom above both CCTV footages was seized.

H. I be informed (Hard Disk Drive) HDD Serial number wherefrom above both CCTV footages was seized.

I. I be informed number of channels, number of cameras connected and recording capacity of above DVR and HDD, wherefrom above both CCTV footages was seized.

NOTE-III: Vide C.I.C. order dated 08.04.2019 Ex.C-6 directed supervisory IO/DSP(Crime)/ CPIO as: "Commission directs CPIO to provide complete information to appellant, after procuring the same from the concerned COURT along-with Digital File Size of Relevant Time of TWO functional CCTV cameras, free of cost.."

J. I be supplied Documentary PROOF whereby DSP(Crime)/CPIO procured CCTV camera footages of MAIN-GATE and MEETING dated 23.02.2017 of relevant time of 04:00 p.m. to 06:00 p.m. (TWO hours footage each)

from the Court in-compliance of said CIC directions.

K. If "Reply to above is 'NO proof' " I be supplied CCTV camera footages dated 23.02.2017 of MAIN-GATE and MEETING of relevant time period of 04:00 p.m. to 06:00 p.m. on judicial record of this Court, as stated by JMIC Bharat under his signature in above said order.
