Therefore, it is felt desirable to pass a common order in both cases.

2nd Appeal/Complaint dated : 01.04.2024, 09.04.2024 Information sought:

1. The Appellant/Complainant filed an (offline) RTI application dated

24.01.2024 seeking the following information:

“Subject: Request for information about employees of Accounts Office, Ponmalai.

Question 1: Give me the details of all the employees attendance worksheet, who worked from 01.01.1999 to 31.01.1999, with their name and designation, give me the information date wise Question 2: Give me the details of all the employees who were absent from 01.01.1999 to 31.01.1999 with their name and designation, give me date wise Question 3: Give me the name list and designation of all the employees retired from 01.01.2013 to 31.12.2014, with copy of their service certificate Question4: Give me the details of retired employees (retired from 01.01.2013 to 31.12.2014) who received 7th pay commission amount with their name and designation.

Question5: Give me the details of retired employees (retired from 01.01.2013 to31.12.2014) who didn't received 7th pay commission amount with their name and designation.”

2. The CPIO furnished a reply to the Appellant/Complainant on 13.02.2024 stating as under:

“Question No.1 &2: Employees Attendance worksheet for the period from 01.01.1999 to 31.01.1999 is pertaining to more than 20 years record. As per the existing rule of Railway preservation period for attendance worksheet is 10 years only. Hence, the records are not available in this office.

Question No.3: The list of retired employees with name and designation for the period from 01.01.2013 to 31.12.2014 are furnished in Annexure- A. The Service certificates are the personal record of retired employees. Hence, the information sought by you is a personal information of third parties which is exempted from disclosure in terms of Sec.8(1)(j) of RTI Act 2005, the disclosure of which has not relationship to any public activity or interest, or which would cause unwarranted invasion of the privacy of the individual.

Question No.4: Revision of Pension for retired employees from 01.01.2013 to 31.12.2014 in Annexure -A are made as per 7th Pay Commission Recommendation Question No.5: Provided to all the Retired employees from 01.01.2013 to

31.12.2014 as per Annexure-A.

3. Being dissatisfied, the appellant/complainant filed a First Appeal dated

15.02.2024. The FAA order is Not on record.

4. Feeling aggrieved and dissatisfied, appellant/complainant approached the Commission with the instant Second Appeal and Complaint.
