1. The Appellant filed an RTI application on 09.07.2024 seeking the following information :
“Sir The applicant hereby seeking the relevant following information regarding the plots Allotment measurements of the Block A to P Aruna Nagar,Majnu ka Tilla Civil Lines,Delhi-110054
1) Whether the said Area/Colony Aruna Nagar Majnu Ka Tila Civil Lines Delhi-110054 Developed by the DDA, Ministry of Housing & Urban Affairs?
2) kindly provide me the all Documents of the said Area/colony of the Actual plot Allotment measurements of the Block A to P Aruna Nagar Majnu Ka Tila Civil Lines Delhi-110054 along with Layout Plan?
3) kindly provide me the Details in which year Block A to P Aruna Nagar Majnu Ka Tila Civil Lines Delhi-110054 Were allotted/measurements and How many plots was constructed for allotments? With measurements/Sq yeads of the plots?
4) kindly provide me the actual plot measurements of the time of the Allotment of the House No F-1 Aruna Nagar Majnu Ka Tilla Civil Lines Delhi-110054 along with Layout Plan?
5) And also provide me the current time measurement status of the House No F-1 Aruna Nagar Majnu Ka Tilla Civil Lines Delhi 110054?
6) kindly provide me the All Details concerned jurisdiction Development authority of Slack A to P Aruna Nagar Majnu Ka Tilla Civil Lines Delhi-110054?”
2. The CPIO furnished a reply to the appellant on 12.08.2024 stating as under:
“िवषय :- आर.टी.आई के अंतगत सूचना ा करनेहेतु। (रिजेशन नः- LADOF/R/E/24/00206 िदनांक 09.07.2024) आपके ारा सूचना के अिधकार अिधिनयम 2005 के अंतगत िदनांक 09.07.2024 को िकयेगयेआवेदन ममॉगी गई सूचना का मवर उर िन कार सेहै :- 1. आवेदन मउेखत े/कॉलोनी का ािम भूिम तथा िवकास कायालय का है। 2. इस िवभाग मउपल रकाड के अनुसार NAC Plan-5 के अनुसार अणानगर, मजनूका टीला, िसिवल लाइंस, िदी की 20.760 एकड़ जमीन िदी नगर िनगम के अिधकार महै। अतः मॉगी गई सूचना िदी नगर िनगम के कायालय सेा कर। 3. इस िवभाग ारा 13.7 एकड़ जमीन तालीन िदी ुिनिसपल कमेटी (DMC) को फाईल सं. L-III-15(37) के ारा हांतरत की गई थी। शेष 7.06 एकड़ जमीन पर भी िदी नगर िनगम का का है। 4. मॉगी गई सूचना िदी नगर िनगम के कायालय सेसंबंिधत है। 5. मॉगी गई सूचना िदी नगर िनगम के कायालय सेसंबंिधत है। 6. माँगी गई सूचना िदी नगर िनगम के कायालय सेसंबंिधत है। “
3. Being dissatisfied, the Appellant filed a First Appeal on 14.08.2024. The FAA vide its order on 30.09.2024 stating as under:
“आदेश आपकी थम अपील संा एलएडडीआएफ/ ए/ई/24/00040 िटनाक 13.06.2024 के सदभ म. मामलेका अवलोकन करनेके पात एत्वारा यह सूिचत िकया जाता है िक आपके 09.07.2024 का अिभयता अिधकारी/क ीय जन सूचना अिधकारी के प सा पतन/15-7(RTI)/2024/175 िदनांक 12.08.2024 ारा दान की गई जानकारी एकदम सही है। (ितिलिप सल). यिद िफर भी आप दी गयी सूचना से संतु नहींहैतो िकसी भी बुधवार को दोपहर 02.00 से 04.00 बजेके वीच इस कायालय आकर अपना प रख सकतेहै। अत थम अपील िदनांक 13.08.2024 का िनारण िकया जाता है।“
4. Feeling aggrieved and dissatisfied, Appellant approached the Commission with the instant Second Appeal.

5. Proof of having served a copy of a second appeal to the respondent while filing the same in CIC is not available on record.
6. The Appellant is not present despite service of notice of hearing and despite the intimation of hearing being given via telephone and email of registry.
7. The respondent while defending their case inter alia submitted that the information sought by the Appellant substantially pertains to the records maintained by the Municipal Corporation of Delhi (MCD), which is a separate public authority under the RTI Act. It was further submitted that as per the available records of L&DO, the land in question measuring 20.760 acres at Aruna Nagar, Majnu Ka Tila, Civil Lines, Delhi falls under the administrati
