The Appellant filed an RTI application dated 07.11.2023 seeking information on following points:-

1. “Please provide the recorded reasons and copy of documents submitted by Aslam Sharrif to remove his wife's name from the passport.

2. Please inform the actions that can be taken against Aslam Sharrif for the same if summitted documents are fake or not true.”

The CPIO, Passport Office vide letter dated 08.12.2023 replied as under:-

“Reply to Point no 1 & 2: The Personal information of a passport holder cannot be disclosed to third party U/s 8 (1) (j) of the RTI Act 2005. The honorable High Court of Delhi in the case of Union of India Vs. R.Jayachandran in W.P(C) 3406/2012 has ordered that passport details of any individual/documents submitted with Passport application form and information connected therewith, cannot be disclosed to a third party under the RTI Act.”

Dissatisfied with the response received from the CPIO, the Appellant filed a First Appeal dated 11.12.2023. The FAA vide order dated 09.01.2024 upheld the reply of CPIO.

Aggrieved and dissatisfied, the Appellant approached the Commission with the instant Second Appeal.

Decision:

Upon the perusal of the case records & submissions, the Commission observes that an appropriate reply has been provided by the CPIO. No further action lies.
