1. The Appellant filed an RTI application dated 15.07.2024 seeking information on the following points:

1. I, Deepanshu Garg, A student from Delhi University would like to attain Duplicate Copy of my Examination Answer Sheet which was held on 17/12/2023 at Sri Guru Tegh Bahadur Khalsa College, University of Delhi, Delhi 110007. My Exam Roll No is 21345225322 for your reference. Exam Subject Name was Education: MAKING THE WORKPLACE INCLUSIVE with Unique Paper Code 62433902. Either Soft Copy or Hard Copy would be sufficient. This information is required for verification purpose. I did recently submitted the same RTI with No HEDUD/R/2024/60074 to Higher Education Department of Delhi but they have replied that it does not pertains to their department hence I need to contact University of Delhi on this case. I hope you will do the needful.

2. The CPIO replied vide letter dated 02.08.2024 and the same is reproduced as under :-

“This has reference to the above original application. The information sought by the applicant was endorsed to the Joint Registrar (Exams) / Nodal Officer (RTI-

Exams), who is the concerned deemed PIO under section 5(4) and 5(5) of the Act.

Relevant input has been received from the Joint Registrar (Exam) / Nodal Officer (RTI) / Assistant Controller of Examinations (Revaluation) in this regard, wherein the deemed PIO has informed that the information sought under the RTI application is not available with the Revaluation Section as Revaluation Section is not the custodian of the Evaluated Answer Scripts of the students. The evaluated answer scripts are provided to Revaluation Section on requisition basis by Strong Room Section. A requisition has been sent to Strong Room Section for providing Evaluated Answer Script of the applicant.

The copy of evaluated answer script(s) will be provided to the applicant as soon as it is obtained from the Strong Room Section. The RTI applicant will be informed about the availability of the copy of Evaluated Answer Scripts or alternatively he/she may contact these nos. 011-27666238 & 011-27001031. The applicant may also visit the Section Officer/Assistant Registrar//Joint Registrar (Exams) / Nodal Officer (RTI) in the Examination Wing for further assistance in this matter.”

3. Dissatisfied with the response received from the CPIO, the Appellant filed a First Appeal dated 16.08.2024 alleging that the information provided was incomplete, false and misleading. The FAA vide order dated 28.08.2024 stated as under: -

“The Original Application, the First Appeal and the reply of the CPIO have been perused in this matter.

On perusal of the records, it has been noticed that the CPIO has responded to the OA vide decision dated 02.08.2024 with a direction to the Assistant Controller of Examinations (Revaluation) to provide the relevant information to the applicant.

On perusal of the first appeal, it has been observed that the appellant has not yet received the information requested in the OA. Therefore, Joint Registrar (Examinations)/ Nodal Officer (RTI-Exams) is directed to provide the relevant information as requested in the OA directly to the appellant under intimation to the Information Section as per procedure immediately on receipt of this Order.”

4. Aggrieved with the FAA’s order, the Appellant approached the Commission with the instant Second Appeal dated Nil.
