A Public Information Officer is under no obligation to create, interpret, or provide explanations for hypothetical questions that do not exist within the scope of information defined under Section 2(f) of the RTI Act, 2005.
Headnote:The appellant filed an RTI application seeking clarifications on whether addressing police officers as "Jai Hind Sir" is unconstitutional or amounts to fraud. The CPIO denied the information stating it was vague and hypothetical, and not information under Section 2(f) of the RTI Act, 2005. The Commission observed that the RTI Act only entitles citizens to information existing in material form in legitimate records. The main issue is whether the CPIO is obligated to provide explanations or interpretations for hypothetical queries. The Commission reasoned that the RTI Act does not require the Public Information Officer to create information, provide legal interpretations, or answer hypothetical questions that do not exist in the official records. The appeal is disposed of as the Commission found no grounds for interference with the CPIO’s decision.

“1. ीमान भा भारत का कोई आम नागौरक िकसी आईपीएस (I.P.S.) या िकसी रा৸ के पुिलस अिधकारी को अगर उनके स(cid:643)ान म७ " जय िहंद सर" बोलता है तो भा यह असंवैधािनक है? भा भारत के आम नागौरक को भारतीय संिवधान म७ " जय िहंद ” बोलने का अिधकार नही ं है, अगर ऐसा है तो कृपया िव(cid:721)ार से बताएं?
2. अगर नही ंहै? तो िकस आधार पर या भारतीय संिवधान के िकस धारा के अंतग१त नही ंहै? कृपया अिधकृत पेपर संल্ करते ॽए इन सभी बातो ंको कृपया िव(cid:721)ार से बताएं।
3. यिद अगर भारत का आम नागौरक िकसी आईपीएस (I.P.S.) या िकसी रा৸ के पुिलस अिधकारी को " जय िहंद सर" बोल देता है तो भा वह भारतीय नागौरक कोई " फज५वाड़ा " कर रहा है? भा जय िहंद बोल देने से वो भारतीय नागौरक "फज५ (cid:681)्ঢ " िस(cid:544) हो जाता है?
4. ीमान अगर ऐसा नही ंहै तो आपसे िवनए अनुरोध है िक आप िबहार पुिलस मुূालय एवं िबहार रा৸ के सुपौल िजला ऋशासन एवं साथ ही साथ सुपौल िजला के पुिलस अधीक को एक अिधकृत पआ िलखकर इस जानकारी से अवगत कराएं एवं आपके (cid:554)ारा भेजे गए उस पआ की एक ऋित भी हम७ इस जवाब के साथ संल্ करते ॽए भेज७।
5. साथ ही साथ ये भी बताएं िक, भा िबहार रा৸ के सुपौल िजले के ऋशासन एव ंउनके पुिलस अधीक को इस बात का अिधकार है िक, भारत का एक नागौरक जब उनके स(cid:643)ान म७ एवं देश पर गव१ करते ॽए उ(cid:590)७ " जय िहंद सर" बोलकर संबोधन करता है तो, भा वो नागौरक उस समय भारत देश या िबहार रा৸ के पुिलस ऋशासन या िफर भारतीय संिवधान से फज५वाड़ा कर रहा है? भा उस (cid:681)्ঢ को िसफ१ इस बात पे फज५ (cid:681)्ঢ कहना उिचत है? भा सुपौल िजला के वत१मान पुिलस अधीक के (cid:554)ारा ऐसा कहना उस (cid:681)्ঢ के आ(cid:527)स(cid:643)ान का हनन नही ंहै? भोिंक िकसी भी भारतीय (cid:681)्ঢ का स(cid:643)ान के साथ जीना उसकी मूल एवं संवैधािनक अिधकार है तो, सुपौल पुिलस अधीक के (cid:554)ारा उस (cid:681)्ঢ के आ(cid:527)स(cid:643)ान से जीने के अिधकार को चोट पॽंचाना उसके मूल एवं संवैधािनक अिधकार का हनन नही ंहै? अगर ऐसा है तो आपसे िनवेदन है िक उपरोঢ बातो ंपर सं৯ान लेते ॽए िबहार रा৸ के सुपौल िजला के पुिलस अधीक पर अनुशासना(cid:527)क कार१वाई करने का भी िनद८श दे एवं उसे िदए गए िनद८श की एक अिधकृत ऋित भी इस जवाब के साथ संल্ करके हम७ भेज७। “

“कृपया आपके (cid:554)ारा आर. टी. आई. अिधिनयम, 2005 के अंतग१त सूचना हेतु ऋेिषत आवेदन पआ िदनांक 18.08.2024 (गृह मंआालय पंजीकरण संূा MHOME/R/E/24/04011 िदनांक 18.08.2024) का स(cid:573)भ१ ঁहण कर७ । जहाँ तक आपके (cid:554)ारा मांगी गयी सूचना का स(cid:638)(cid:576) है, तो िविदत है िक मांगी गयी सूचना अ(cid:729)(cid:700) तथा का(cid:665)िनक त(cid:538)ो ंपर आधाौरत है जो िक सूचना के अिधिनयम, 2005 की धारा 2(f) के अंतग१त दी गयी सूचना की पौरभाषा के अनुॺप नही ंहै।
अतः वांिछत सूचना ऋदान करना संभव नही ंहै। “

“Shri Hemant Kumar, Ward No. 18, Gandhi Nagar, Janta Road, Near BSNL Office, Sough from Petrol Pump, Triveniganj, Supaul, Bihar, Pin 852139 had submitted an application (Regn.No. MHOME/R/E/24/04011 dated 18.08.2024) seeking information under the RTI Act, 2005 .
2. The CPIO vide letter dated 13.09.2024 informed the applicant that "The information sought is vague and based on hypothetical facts, not covered by definition of information envisaged under section 2(f) of the RTI Act, 2005 ".
3. Aggrieved to the aforesaid reply of CPIO, Shri Hemant Kumar has preferred a First Appeal dated 19.09.2024 (Ref. No.MHOME/A/E/24/00725) stating the provided information Incomplete, Misleading or False.
4. The RTI application, reply of the CPIO and the Appeal dated 19.09.2024 of Shri Hemant Kumar have been gone through. It has been noted that the CPIO vide letter dated 13.09.2024
