CENTRAL INFORMATION COMMISSION
Sudha Rani Relangi, Information Commissioner
Suresh Bablani – Appellant
Versus
CPIO National Council for Promotion of Sindhi Language – Respondent
CIC/NCPSL/A/2025/101020

Advocates:
For the Appellants/Petitioners:
For the Respondents: Ms. Lalita, JAAO/ PIO

A public authority under the RTI Act, 2005 is not mandated to create, collect, or collate information that is not already held or available in its official records.

Headnote:(A) Right to Information Act, 2005 - Section 6 - Public authority - Information not available - Duty of CPIO - CPIO is only obligated to provide information held in records and is under no obligation to create or collect information not available with it. (Paras 11, 12)

Facts of the case:
An RTI applicant sought details regarding council committees, honorarium bills, status of book publications, and internal office notes. The CPIO provided a reply and offered an inspection of records. Dissatisfied with the points regarding expert committee payment details, internal office notes, and minutes of meetings, the appellant filed a second appeal.

Findings of Court:
The Commission observed that the respondent had provided a point-wise reply and a subsequent revised response. The CPIO is not obligated to create, collect, or collate information that is not maintained in records. No infirmity was found in the responses provided.

Issues: Whether the CPIO is mandated to provide information not available in the official records or create record and whether the information furnished was adequate.

Ratio Decidendi: Information held by a public authority is limited to what is available in existing records; an applicant cannot compel the public authority to create information that does not exist.

Result: Appeal disposed of.
