2026 Supreme(Online)(CIC) 7196
CENTRAL INFORMATION COMMISSION
Raj Kumar Goyal, Information Commissioner
Gopal Krishan – Appellant
Versus
Central Public Information Officer – Respondent
CIC/MOLAJ/A/2024/140122
The Right to Information Act is limited to providing existing records. It does not mandate public authorities to create information, interpret data, provide expert opinions, or solve hypothetical legal problems, nor is it a substitute for formal grievance redressal mechanisms.
Headnote:(A) Right to Information Act, 2005 - Sections 2(f) and 6(3) - Information sought regarding departmental action and internal complaints - Transfer of application between public authorities - Scope of information disclosure - An applicant cannot seek creation of information, interpretation of records, or solutions to hypothetical problems - Public Information Officer is only a communicator of existing records and not an investigator or researcher. (Paras 5, 10, 11, 12)
(B) Right to Information Act, 2005 - Grievance Redressal - RTI is not an appropriate mechanism for the resolution of private grievances or complaints against professional misconduct - Recourse lies with the competent authority and appropriate statutory bodies. (Paras 13)
Facts of the case:
An applicant sought information regarding actions taken on a past representation, responsibilities concerning professional conduct, and the accountability of legal professionals upon the death of an advocate. The application was transferred between distinct public authorities. The appellant alleged non-receipt of the requested information and challenged the lack of action on a complaint filed against a professional body.
Findings of Court:
The court observed that the application for information was correctly transferred by the public authority under the relevant provisions. While the transfer was delayed beyond the statutory timeline, no mala fide intent was established. The information provided by the responding authority was considered consistent with the Act's provisions. The court emphasized that the disclosure of information is limited to what is held in material form within records and denied the demand for explanations or hypothetical answers.
Issues: Whether the information requests constituted 'information' under the Act and whether the RTI process can be utilized as a forum for grievance redressal against professional bodies.
Ratio Decidendi: An Information Officer is only required to provide existing information held in records under Section 2(f). Requests for explanations, justifications, or the creation of new information fall outside the scope of the legislation. Furthermore, the RTI process cannot be substituted for prescribed legal procedures for grievance resolution.
Result: Appeal disposed of as the information request and grievance fell outside the scope of the Act.
