Failure to provide RTI responses within statutory timelines without evidence of malafide intent leads to the issuance of a strict caution rather than the invocation of penal proceedings under Section 20 of the RTI Act.

Headnote:The case involves a complaint filed under the Right to Information Act, 2005 (RTI Act) regarding the failure of a public authority to provide timely and complete information concerning the recovery of National Holiday Allowance (NHA) from employees of the Railway department. The Complainant sought clarity, supporting rules, and records for the recovery process and sought copies of relevant letters. The Commission found that while the public authority failed to provide a timely response within the statutory period prescribed under S.7(1) of the RTI Act and failed to maintain adequate proof of dispatch, there was insufficient evidence of malafide intent or deliberate obstruction to warrant penal action under S.20. The core issues framed were whether the Respondent complied with the statutory timelines for providing information and whether the failure to furnish such information amounted to a deliberate obstruction of justice. The Commission reasoned that administrative delays coupled with a failure to maintain proper postal records for RTI responses indicated a casual approach to the discharge of duties, necessitating a caution for future compliance rather than the initiation of punitive measures. The Commission cautioned the concerned PIO and the custodian of records to ensure strict adherence to timelines and record-keeping requirements, disposing of the complaint without further penal action.
