The Appellant filed an RTI application dated 03.11.2023 seeking information on following points:-

“1 Certified Copy of at Heavy Water Plant Manuguru Department of Atomic Energy during the period 01.01.2010 to 31.10.2023 Number of complaints as filed regarding Sexual Harassment of women at work place. 2 Certified Copy of at Heavy Water Plant Manuguru Department of Atomic Energy during the period 01 01 2010 to 31.10.2023 Annual reports submitted to the concerned Department/Ministry/Competent authority by the Complaint Committee on Sexual Harassment Details may please provide.

3 Certified Copy of at Heavy Water Plant Manuguru Department of Atomic Energy Complaint details of enquiry and investigation committee setup for solving the Complaints/Case and the reports submitted by the committee thereafter. The action taken/punishment given based on the conclusion of the enquiry committee to the convicts. (Compliant names need not be mentioned) details may please provide.

The CPIO, Chief administrative Officer vide letter dated 01.12.2023 replied as under:-

“1-2. 02 cases-Annual reports as available are enclosed.

* Total number of cases in Annual reports in indicated as 3 as one case is repeated.

3. Information sought is exempted under section 8(1)(j) of RTI Act, 2005 4. Information sought is exempted under section S(1)(j) of RTI Act, 2005 5. Information sought is exempted under section 8(1)(j) of RTI Act, 2005

6. Copies of ICC Reconstitution order No.HWPM/R/20/2022/1321 dated

19.09.2023 and Guidelines circular dated 12.09.2023 are enclosed.”

Dissatisfied with the response received from the CPIO, the Appellant filed a First Appeal dated 10.12.2023. The FAA, General Manager vide order dated

05.01.2024 replied as under:-

“As the information sought by the applicant in point No.3,4,5 i.e punishment given to the convicts, FIR details & relief provided to aggrieved woman respectively fall under the definition of personal information and hence the same were denied by CPIO under section

8(1)(j) of RTI Act, 2005.

Accordingly, the undersigned upholds the reply dated 01.12.2023 furnished by CPIO.”

Aggrieved and dissatisfied, the Appellant approached the Commission with the instant Second Appeal.

Written submission dated 14.06.2025 has been received from the CPIO, Heavy Water Plant, Department of Atomic Energy and same has been taken on record for perusal. The relevant extract whereof is as under:
