Relevant facts emerging from appeal:

Information sought:

The Appellant filed an RTI application dated 19.07.2023 (offline) seeking the following information:

“1. मकान न 64, शाती वहार कड़कड़डूमा मेचोथी मंिजल क छत पर जो लैट वालेहै

उहोनेसन 2022 म छत पर क

ु

छ क"#कशन क थी जो MCD ने xxxxxxxx क थी

उसका $या कारण था।

2. य(द कोई +शकायत थी तो +शकायत पर काय,वाह- क ./त उपल0ध कराई जाए।

3. इस वष,5फर काम चल रहा हैइसक प+म,शन क ./त भी उपल0ध कराई जाए।

4. इसकेबननेसेबाक लोर वालो पर जो यहाँरहतेहैइसका कोई .भाव तो नह- पड़ेगा

य(द हाँतो $या पड़ेगा और हमेउसके+लए $या करना चा(हए।”

The CPIO furnished a point-wise reply to the Appellant on NIL stating as under:

“1. उपरो$त संप= के अवैध /नमा,ण क सूची म आनेपर, उसके व@Aध तोड़फोड़ क

काय,वाह- DMC Act 1957 के.ावधानB केअन

ुसार क गई है।

2. मांगी गई जानकार- ततीय ृ पD सेसंबंEधत हैअतः आर.ट-.आई. ए$ट 2005 क धारा

8(j) केअGतगत ऐसी सूचना .दान नह-ंक जा सकती है।

3. संप= के मा+लक अपनेवा"तुकार से.ामाIणक न$शेक छाया./त ऑनलाईन

पोट,ल से.ाKत कर सकतेहैजब5क ततीय ृ पDीय / पाटL ऐसी छाया./त .ाKत नह-ंकर

सकतेहै।

4. .ाथM ने इस वभाग म उपल0ध Nरकॉड,सेसंबंEधत कोई "पPट जानकार- नह-ं मांगी

है।”

Being dissatisfied, the appellant filed a First Appeal dated 28.08.2023. The FAA vide its order dated 06.09.2023, held as under:

“The case was fixed for hearing of appeal on 05.09.2023 at 11.00 AM. During hearing, appellant was not fully satisfied with the reply provided by PIO. On the other hand, representative of PIO stated that the reply has already sent to the appellant as per available record.

PIO is hereby directed to provide proper reply to the appellant in the revised reply within 10 days of this order.”

Feeling aggrieved and dissatisfied, appellant approached the Commission with the instant Second Appeal.

A written submission dated 27.01.2025 (copy marked to the appellant) has been filed by Shri Pushpender Kumar, EE(B-I)/ PIO/S. Zone, MCD is taken on record. Contents of the same are reproduced below:

“1. Sh. Subhash Chandra Agarwal, appellant, R/o *******, Shanti Vihar, Karkardooma, Delhi-110053 filed an online RTI application on 19.07.2023 in AO (CSB), Shahdara South Zone and the same was received in the office of Executive Engineer (Building)-I, Shahdara South Zone, MCD on 19.07.2023 seeking certain information in respect of Property No.64, Shanti Vihar, Karkardooma, Delhi

II. Accordingly, the PIO/EE (B)-I, SSZ provided the available requisite information vide letter no. EE(B)-I/Sh.(S)/RTI ID No. 376/2023/D-464 dated 21.08.2023 from record to the appellant. The copy to this effect is annexed as Annexure- А.

III. Dissatisfied with reply of PIO, the appellant filed the first appeal before First Appellate Authority/SE-I, SSZ in which FAA vide order dated 06.09.2023 with appeal no. 157 directed that

" PIO is hereby directed to provide proper reply to the appellant in the revised reply within 10 days of this order.

Accordingly, appeal is disposed off "

IV. Accordingly, the PIO/EE (B)-I, SSZ provided the available revised information vide letter no. EE(B)-I/Sh.(S)/RTI ID No. 376/2023/D-546 dated 26.09.2023 through speed post on 30.09.2024 vide speed post no. ED4076773965IN (Annexure B1 & B2).

In reference to Appeal/FAA order no.SE-I/Shd(S)/Zone/2023/D-607 dated 06.09.2023, Appeal No.157. It is informed that all requisite information had already been provided on 21.08.2023. However, the information available on record is again being sent in compliance of the orders of First Appellant Authority as under: -
