1. The Appellant filed an RTI application dated 06.06.2023 seeking information on the following points:

और काया१लय (঴ेिআय काया१लय या अंचल काया१लय) आपकी शाखा भारतीय ौरज़व१ ब॰क (आर०बी०आई०), ौरजव१ ब॰क एकीकृत लोकपाल काया१लय, 74/1, राजपुरा रोड, देहरादून 248001, उ(cid:517)राखंड, भारत। दूरभाष (0135) 2742001, ईमेल - boslehradun@rbi.org.in के अ(cid:566)ग१त आपके काया१लय के ঴ेআ अिधकार के अधीन है?

2) यह िक मेरी फ़म१ मैसस१ इ(cid:580)ोवेशन पॉलीमस१ के ब॰क ऑफ बड़ौदा, ॹঈपुर (मुূ शाखा), चालू खाता संূा **********6862 के चेक संূा: ****97 के िवषयक भारतीय ौरजव१ ब॰क के ब॰िकंग लोकपाल, देहरादून िशकायत संূा: ************5110 के स(cid:638)ंध म७ ब॰क ऑफ बड़ौदा, ঴ेिআय काया१लय (ह(cid:821)(cid:554)ानी), उप महाঋबंधक (cid:554)ारा जारी पআ संূा ঴े.का.ह./34/िशकायत /75, 13 माच१, 2020 म७ विण१त ब॰क ऑफ बड़ौदा, ঴ेिআय काया१लय (ह(cid:821)(cid:554)ानी), सतक१ता िवभाग (cid:554)ारा की गई सतक१ता जांच ौरपोट१ की ঋमािणत छाया ঋित /ঋितिलिप सूचना का अिधकार अिधिनयम 2005 के अ(cid:566)ग१त ঋदान करने की असीम कृपा

करे।

3) यह िक भारतीय ौरजव१ ब॰क पौरपআ संূा:RBI/2014-15/294 DBS.CFMC.BC.No.006/23.04.001/2014-15, November 5,2014 "Cheque Related Fraud Case - Preventive Measures" के अधीन ब॰क ऑफ बड़ौदा (cid:554)ारा सभी ब॰िकंग शाखा को जारी िदशा-िनद८श स(cid:638)्(cid:576)त पौरपআ वष१ 2014-15, 2015-16, 2016-17 और

2017-18 की ঋमािणत ঋितिलिपयाँ सूचना म७ ঋदान करे।

4) यह िक ब॰क ऑफ बड़ौदा (cid:554)ारा सभी ब॰िकंग शाखाओं को जारी िदशा-िनद८श "Precaution to be taken in respect of Inter-SOL Transfer/Clearing Transactions." स(cid:638)्(cid:576)त पौरपআ वष१ 2014-15, 2015-16, 2016-17 और 2017-18 की ঋमािणत ঋितिलिपयाँ सूचना

म७ ঋदान करे।

5) यह िक कृपया कर अपने ঋथम अपीलीय ঋािधकारी के नाम, पदनाम, पता आदी की पूण१ सूचना िनयम अनुपालन म७ ঋदान करे।

2. The CPIO replied vide letter dated 30.06.2023 and the same is reproduced as under:-

अतः जन सूचना अिधकारी मांगी गई जानकारी / सूचना देने म७ असमथ१ है।

ॿम संূा 3-4 म७ वांिछत सूचना के ॿम मे आपको सूिचत िकया जाता है की आपके (cid:554)ारा मांगी गई वांिछत सूचना असप(cid:700) ঋतीत होती है। आगे हम आपको अवगत कराते है की ब॰क ऑफ बड़ौदा जनता के िलए उपल(cid:617) अपने उ(cid:523)ादों / सेवाओं /सुिवधाओं के बारे म७ अ(cid:552)तन जानकारी / कोई अ(cid:586) सूचना, िजसका खुलासा िकया जा सकता है, अपने साव१जिनक डोमेन पर देता है तथा जनता इसे कॉपॳरेट वेबसाइट पर देख सकती ह॰ तथा आगे सूिचत हो की ब॰क ऑफ बड़ौदा एक रा(cid:700)३ीयकृत ब॰क है व भारतीय ौरजव१ ब॰क (cid:554)ारा समय समय पर जारी सभी िदशािनद८शों का पालन करता है और भारतीय ौरजव१ ब॰क (cid:554)ारा जारी सभी िदशािनद८श साव१जिनक डोमेन/঴ेআ पर भी उपल(cid:617) ह॰ और माननीय क७ঈीय सूचना आयोग ने Smt. Nirmal Garg V. Securities & Exchange Board of India म७ यह पाौरत िकया है की: "It shall be interesting to examine this proposition. Section 2(j) of the RTI Act speaks of 'the right to information accessible under this Act which is held by or under the control of any public authority.....' The use of the words 'accessible under this Act'; 'held by' and 'under the control of are crucial in this regard. The inference from the text of this subsection and, especially the three expressions quoted above, is that an information to which a citizen will have a right should be shown to be a) an information which is accessible under the RTI Act and b) that is held or is under the control of a certain public authority. This should mean that unless information is exclusively held and contr
