CENTRAL INFORMATION COMMISSION
Vinod Kumar Tiwari, Information Commissioner
Nilesh Pathak – Appellant
Versus
PIO, Brigade of the Guards Regimental Centre – Respondent
CIC/IARMY/C/2024/619208

Advocates:
For the Appellants/Petitioners: Vinay Kumar Mishra
For the Respondents: Vaibhav

The Commission's jurisdiction under Section 18 of the Right to Information Act is limited to examining mala fide intent or delays. Converting a complaint into a second appeal is impermissible when the statutory conditions and procedural requirements for an appeal have not been formally met by the complainant.

Headnote:(A) Right to Information Act, 2005 - Sections 7(1), 8(1)(g), 18 and 20 - Scope of Commission's authority under Section 18 - Complaint concerning denial of information - Appellate authority for providing information is not applicable during complaint proceedings under Section 18 when the mandate of the Commission is limited to examining alleged 'mala fide' intent or deliberate denial - Commission finds no mala fide as information was provided within statutory timelines - The request to convert a complaint into an appeal cannot be entertained when a prior writ petition was withdrawn for that specific purpose and no fresh appeal was filed before the Commission. (Paras 10, 11)

Facts of the case:
The complainant filed an application seeking documents related to recruitment notifications from a previous period. The respondent authority denied the request citing security concerns and internal communication processes, claiming the documents were not public notifications. The complainant, being an unsuccessful participant in the process, moved the Commission via a complaint under Section 18, alleging deliberate denial and requesting the conversion of the complaint into a second appeal following the withdrawal of a writ petition before the High Court.

Findings of Court:
The Commission observed that the respondent had provided a timely response. The respondent clarified that no formal public notification existed for the period in question, only internal communications, and offered to share redacted records. The Commission held that since the original matter was filed under Section 18, it could not adjudicate as an appellate body under Section 19. No mala fide was established to warrant punitive action under Section 20.

Issues: Whether the Commission can convert a complaint under Section 18 to a second appeal under Section 19, and whether the respondent is obligated to provide documents for a recruitment process that did not involve public notifications.

Ratio Decidendi: The Commission's role under Section 18 is confined to investigating the existence of mala fide intent or deliberate withholding of information. Once a timely response is provided and no intent to deceive is proven, the petitioning party cannot demand the conversion of a complaint into an appeal to seek substantive relief that exceeds the Commission's narrow statutory scope under that provision.

Result: Complaint disposed of.
