O R D E R

1. The Appellant filed an RTI application dated 06.12.2024 seeking information on the following points:

1. Minutes of General council for last 10 Meetings.

2. Appoved agenda against of Minutes of last 10 Meetings.

3. Powers and Functions of General council?

4. Minimum attendence percentage of General council to pass the Minutes?

5. Is General council is competant to take up service matters?

Write back via Email in case of any clarification.

2. The CPIO replied vide letter dated 31.12.2024 and the same is reproduced as under:-

“It is not meant for public circulation

Powers and functions of General Council is mentioned in the Constitution of LKA under clause no. 9. of Gener Rules and Regulations and the same has been uploaded on Akademi's website

Mentioned in the constitution of LKA under clause no. 7, Gener Rules and Regulations and the same has been uploaded on Akademi's website

Mentioned in the constitution of LKA under clause no. 9. Gener Rules and Regulations and the same has been uploaded on Akademi's website”

3. Dissatisfied with the response received from the CPIO, the Appellant filed a First Appeal dated 31.12.2024 alleging that the information provided was incomplete, false and misleading. The FAA vide order dated 24.01.2025 upheld the reply given by the CPIO.

“In this regard it may kindly be intimated to the CPIO that whether the Appellant is employee of the Akademi and information sought pertain to the Appellant. The CPIO is hereby directed that on receipt of the above information from the Appellant, the same be considered and disposed of and the Appellant may be informed accordingly within 10 working days. The appeal is disposed of accordingly.”

4. Aggrieved and dissatisfied, the Appellant approached the Commission with the instant Second Appeal dated 04.04.2025.

5. The Appellant remained absent despite due service of hearing notice.

6. The Respondent remained absent and it was noted that the hearing notice was not delivered to the correct address of the Respondent.

Interim Decision:

7. Upon perusal of the records, it is observed that the hearing notice sent to the Respondent was not delivered at the correct address, and the Appellant was absent during the hearing. In the absence of any submissions from either party, the Commission is unable to properly adjudicate the present matter.

8. In view of the above, the matter is adjourned. The Registry of this Bench is directed to re-list the present matter after 15 days. The notice of hearing shall be sent to the correct addresses of the parties. The matter stands adjourned accordingly.

Copy of the decision be provided free of cost to the parties.

Hearing notice dated 20.05.2026 has been issued by the Registry to both the parties.

9. The Respondent stated that the relevant information has been duly provided to the Appellant. She averred that point-wise reply has been provided to the Appellant as per the provisions of the RTI Act. A written submission dated 04.06.2026 has been received from the CPIO and same has been taken on record for perusal. The relevant extract whereof is as under:

“..Kindly refer to the notice number CIC/LKALA/A/2025/615762 dated 20.5.2026 issued by the Hon'ble Central Information Commission on the subject cited above. Date of hearing is 08.06.2026

In this regard, please find enclosed herewith the Written Submission/Counter Reply on behalf of the Respondent Public Authority for kind consideration of the Hon'ble Commission.

In view of the above, it is respectfully prayed that Hon'ble Commission may kindly take the written submission on record and dispose of the appeal accordingly.
