2. Being dissatisfied, the Appellant filed a First Appeal dated 27-02-2025.

The FAA vide its order dated 17-03-2025, upheld the reply given by the CPIO.

3. Feeling aggrieved and dissatisfied, Appellant approached the Commission

with the instant Second Appeal.

Relevant Facts emerged during Hearing:

The following were present:-

Appellant: Absent.

Respondent: Mr. Manick Biswas, DGM (LPG Sales), attended the hearing

through video conference.

4. The Respondent submitted, that the appellant sought information

regarding the total number of LPG distributorships under the jurisdiction of

Gorakhpur Area Office; their complete list; the total number of agencies that

were investigated by the QRC team; action taken against the agencies and fine

or penalty imposed on them etc. The respondent submitted, that they had

provided the numerical figures, with respect to the total number of LPG

distributorships under the jurisdiction of Gorakhpur Area Office; their complete

list and the total number of agencies that were inspected by QRC team from 1^st

April, 2022, to 20^th December, 2024, to the appellant, vide letter dated

CIC/IOCLD/A/2025/115418 Page 3 of 5

04.02.2025. The respondent further submitted, that the information regarding

the QRC team’s action against each gas agency, and the amount of fines

imposed is commercially confidential and business information, regarding the

Corporation’s policies and regulations, the disclosure of the same may harm the

competitiveness of third-party distributors. Hence, the same is exempted U/s

8(1)(d) of the RTI Act, 2005.
