Facts of the case:
The appellant filed a RTI application seeking information about the number of first appeals received and the details of orders passed by the First Appellate Authority during 2023-2024 and 2024-2025. Upon being dissatisfied with the initial response offering an inspection, the appellant approached the Commission in a Second Appeal.

Findings of Court:
The Commission observed that the Public Information Officer had furnished the requested factual data regarding the disposal of appeals and had already offered an opportunity for inspection. The appellant’s absence at the hearing indicated a lack of interest in the proceedings.

Issues: Whether the information provided by the public authority satisfies the requirements of the RTI Act regarding transparency and disclosure.

Ratio Decidendi: If the Public Information Officer provides a factual update on the information sought and the appellant fails to pursue the matter through attendance or written submissions, the Commission finds no grounds for further intervention.

Information sought:

1. The Appellant filed an RTI application on 30.09.2024 seeking the following information :

“1) विगत वित्तीय वर्ष 2023-24 एवं वर्तमान वित्तीय वर्ष 2024-25 के अब तक (30/09/2024 या सूचना उपलब्ध कराने की तिथि तक) प्रथम अपीलीय प्राधिकारी-सह-मुख्य अधिशासी अधिकारी (CEO), दानापुर छावनी परिषद दानापुर क॰ट, के समक्ष कितने प्रथम अपील आवेदन (ऋपआ-छ) (सूचना के अधिकार अधिनियम 2005 के तहत ) प्राप्त हुए, उक्त प्राप्त प्रथम अपील आवेदन (ऋपआ-छ) पर प्रथम अपीलीय प्राधिकारी-सह-मुख्य अधिशासी अधिकारी के द्वारा किये गये कृत कारवाई / अद्यतन स्थिति से अवगत करावे ! सूचना के अधिकार अधिनियम की धारा-19(1) के तहत प्रथम अपीलीय प्राधिकारी का आदेश होना ज़रूरी है कृपया उनके द्वारा प्रथम अपील आवेदन पर पारित आदेश (विगत वित्तीय वर्ष 2023-24 से लेकर अब तक 30/09/2024 तक) की छायाप्रति अभिप्रमाणित किया गया उपलब्ध करावे!”

2. The CPIO furnished a reply to the appellant on 30.10.2024 stating as under:

“विषयः सूचना के अधिकार अधिनियम 2005 के तहत वांछित सूचना।

संदर्भ: आपका आवेदन दिनांक 30 सितंबर 2024 एवं इस कार्यालय को प्राप्त दिनांक 30 सितंबर 2024

माँग की गई सूचना के आलोक में आपको सूचित किया जाता है कि आप माँग की गई सूचना के आलोक में कार्यालय में स्वयं से उपस्थित होकर कर पंजिका का अवलोकन कर सकते हैं।”

3. Being dissatisfied, the Appellant filed a First Appeal on 02.11.2024. The FAA vide its order on 20.01.2025 stating as under:

“अपील प्रकार: प्रथम अपील दायर करने की तिथि 02 नवंबर 2024 एवं के0लो0सू0पा0 को प्राप्त दिनांक 03 नवंबर 2024

तथ्य: श्री अजय कुमार चौरिसया, आन बाजार, सरकुलर रोड, दानापुर क॰ट, जिला - पटना, पिन कोड - 801503 (बिहार) द्वारा आवेदन दिनांक 30 सितंबर 2024 माध्यम से वांछित सूचना की माँग की गई है एवं इसी आलोक में केंद्रीय लोक सूचना पदाधिकारी द्वारा फाईल संख्या CBD/CPIO/RTI/Request/2023/Oct/1/1094-1034 दिनांक 29/10/2024 से तथ्यवत् सूचना उपलब्ध किया जा चुका है।

निर्णय: माँग की गई वांछित सूचना, जो फाईल संख्या CBD/CPIO/RTI/Request/2023/Oct/I/1094-1034 दिनांक 29/10/2024 द्वारा प्रेषित है की पड़ताल की गई एवं देखा गया कि केंद्रीय लोक सूचना पदाधिकारी द्वारा अपीलकर्ता को उपलब्ध करायी गयी सूचना तथ्यवत् है। अतः केंद्रीय लोक सूचना पदाधिकारी को निर्देशित किया जाता है कि उक्त सूचना को पुनः इस निर्णय के साथ संलग्न कर भेजा जाए एवं मामले का निपटान किया जाए।”

4. Feeling aggrieved and dissatisfied, Appellant approached the Commission with the instant Second Appeal.

5. Proof of having served a copy of a second appeal to the respondent while filing the same in CIC is not available on record

6. The Appellant is not present despite service of notice of hearing.

7. The Respondent while defending their case inter alia submitted that in their initial reply, the appellant was given an opportunity to inspect the sought record, but he did not avail this option. Now revised information has been given stating that 30 applications were received in relation to first appeals during the 2023-2024 financial year and up to 25.10.2024, all of which have been processed and heard.

8. The respondent submitted a reply before the Commission dated 29.06.2026, stating as under:
