Information sought:

1. The Appellant filed an RTI application on 23.10.2024 seeking the following information :

“The under mentioned appellant humbly and respectfully submits as under: -

1) That it is brought to your kind information that in the OROP III Review recently announced by Government of India Min of Defence there has contrarily been reduction in service pension of Honorary Commissioned Officers (HCOs). Apart from this, it seems that there has always been discrimination against this category of special and separate cadre of distinguished and meritorious record holder HCOs ever since 4th CPC otherwise prior to that these HCOs pay and pension used to be kept higher due to their long and distinguished, unmatchable service record

even from British era.

2) That in this regard below noted information/docs, may kindly be obtained from record of Special Pay Commission Implementation Cell, Naval HQ IHQ MoD (Navy) and provided under the provision of RTI Act

to the aggrieved appellant: -

a) In 4th, 5th, 6th, 7th CPCs the basic pay of Honoray Sub Lieut and Honorary Lieutenant may kindly be informed separately as per record

held by the office.

b) In 4th, 5th, 6th, 7th CPCs the basic pay of Regular Sub Lieut, lieutenant and Lieut. C

c) dr may kindly be informed separately.

d) In case there was some modification in the basic pay of aforesaid ranks according to any special Naval Instructions the same may

kindly be supplied in each above rank separately.

e) Additionally, according to OROP I wef 1.7.2014 the figure of basic pay of Honorary Sub Lieut and Honorary Lieut may kindly be informed

separately.

f) The basic pay of Regular Sub Lieut, lieut and Lieut. Cdr fixed in OROP I wef 1.7.2014 may kindly be informed separately.

g) In 3rd, 4th and 5th CPCs the basic pay of Honorary Commissioned Officers (HCOs) ranks was consolidated/fixed at given figure but in 6th CPC the pay of HCOs was fixed at PB 3 (15600-39100), the photocopy of the formula applied in fixing the basic pay while framing and converting it to pay pattern from fixed pattern recommended by your office may kindly be intimated to the

appellant accordingly.

h) Name and postal address of First Appellate Authority under which your office falls may also be intimated for taking further suitable

action at this end.

3) That in case some information sought, don't belong to your office, the same may be transferred to those offices to which they are more closely related under Section 6(3) as per provision of RTI, under

intimation to appellant.”

2. The CPIO furnished a reply to the appellant on 28.11.2024 stating as under:

“1) Refer to RTI application dated 23 Oct 24, seeking information under RTI Act, 2005.

2) The information sought by you is as enumerated below: -

a) Query 2 {(a) to (f)}. SNI No. 1/S/86, 1/S/87 & 1/S/98 are relevant. Copy of the same are for official use only and does not serve any larger public interest/ activity. Basic pay of all ranks was fixed as per the stipulations contained therein. No separate rule applied by Indian Navy other than

those specified by Govt vide above NI/Regulation.

b) Query 2 (g). Details of First Appellate Authority are mentioned at Para

3 below.
