Information sought:

1. The Appellant filed an RTI application on 28.10.2024 seeking the following information :

“डी(cid:649) यूिनवरिसिट ঁािफक एयरा सुभाष नगर दे0 दून XXXXXX पर (cid:725)ािपत है उसका खसरा नंबर व िकतने ঴ेআफल मे िनिम१त व िकतनेन ऐौरये मे संचािलत है

तथा िकतने एौरये का XXXXXX “

2. The CPIO furnished a reply to the appellant on 22.11.2024 stating as under:

“आपके आवेदन पআ िदनांक 28.10.2024 के संदभ१ म७।

2) आपको अवगत कराना है िक, आपके (cid:554)ारा मांगी गई िनजी सूचनाओ ंकी ঒ेणी म७ आती है। अतः सूचना का अिधकार अिधिनयम 2005 की धारा 8 (1)(जे)

के अ(cid:566)ग१त उपल(cid:617) नही ंकरायी जा सकती। “

3. Being dissatisfied, the Appellant filed a First Appeal on 25.11.2024. The FAA vide its order on 11.12.2024 responding to their related RTI

application replied to appellant stating as under:

“आदेश पআावली के अ(cid:559)यन करने पर पाये गया िक लोक सूचना अिधकारी (cid:554)ारा सूचना िनधा१ौरत रमयाविध के अ(cid:573)र आवेदनकता१ को ঋेिषत कर दी गयी धी। चूंिक सूचना तृतीय प঴ से स(cid:638)्(cid:576)त है अतुः सूचना अिधकार अिधिनयम की धारा 11 के अ(cid:566)ग१त तृतीय प঴ से िल्खत अनापि(cid:517) ঋा(cid:593) होने पर सूचना 10 िदन के अ(cid:573)र उपल(cid:617) करायी जाय७, यिद तृतीय प঴ (cid:554)ारा आपि(cid:517) दज१ करायी जाती है तो लोक सूचना अिधकारी (cid:554)ारा पत् सं0 29/सीबीसी/213 िदनांक 22.11.2024, सं0 29/सीबीसी/214 िदनांक 22.11.2024 एवं सं0 29/सीबीसी/216 िदनांक 22.11.2024 के अ(cid:566)ग१त िदया गया जबाव यथागत रहेगा। अपील का िनसारण उपल(cid:617) द(cid:721)ावेजों के आधार पर िकया जाता है। यिद आप िनण१य से सहमत नही

है तो के(cid:574)ीय लोक कुछना आयुঢ, नई िद(cid:671)ी को ि(cid:554)तीय अपील कर सकते है।“

4. In compliance of FAA Order the CPIO furnished a re-vised reply to the appellant on 21.12.2024 stating as under:

“ঋथम अपील की सुनवाई िदनांक 11.12.2024 के संदभ१ म७।

2) आपको अवगत कराना है िक, ঁिफक ईरा शै঴िणक सं(cid:725)ान को इस काया१लय (cid:554)ारा िदनांक 16.12.2024 को पআ भेजा गया था। िजसम७ ঁिफक ईरा िव(cid:695)िव(cid:552)ालय

एवं ঁिफक ईरा िहल िव(cid:695)िव(cid:552)ालय की भूिम, भवन मानिचআ, से स(cid:638)्(cid:576)त सूचना

मांगी गयी थी।

3) ঁिफक ईरा शै঴िणक सं(cid:725)ान (cid:554)ारा यह सूिचत िकया गया है िक, ঁिफक ईरा िव(cid:695)िव(cid:552)ालय एवं ঁिफक ईरा िहल िव(cid:695)िव(cid:552)ालय की भूिम, भवन मानिचআ, से स(cid:638)्(cid:576)त सूचनाय७ उनकी िनजी सूचना है। िजसको तृतीय प঴ को न िदये जाय७।

5. Feeling aggrieved and dissatisfied, Appellant approached the Commission with the instant Second Appeal.

6. The respondent CPIO submitted a Written Submission before the Commission dt 27.07.2026 stating as under:

“SUBMISSION OF CPIO, CANTT BOARD, CLEMENT TOWN IN RESPECT OF ABOVE APPLICATION :-

1) It is submitted that Shri Ravi Kumar Dhiman R/o Rehmatpur, PO Belda, Tehsil Roorkee, Haridwar has filed an application on dated 28.10.2024 (copy enclosed as annxure-1) under the RTI Act 2006 to the Cantt Board, Clement Town. In the above application Shri Ravi Dhiman has seeked

information about the Graphic Era Hill University.

2) The CPIO Cantt Board, Clement Town vide letter No. 29/CBC/214 dated 22.11.2024 (copy enclosed as annexure-2) informed the applicant that the Graphic Era Hill University is situated outside the limit of Cantt Board, Clement Town hence the Cantt Board has no information in this

regard.
