1. The Appellant filed an RTI application dated 29.07.2024 (offline) seeking the following information:

2. The PIO furnished a point-wise reply to the Appellant on 18.10.2024 stating as under:

“1. &रकॉड- के अनुसार उ,त संप D के ऊपर फ़ाइल संGया 159 (cid:6)दनांक 3.6.24 को बु*कंग क/ कायव- ाह(cid:23) क/ गयी है।

2. &रकॉड- के अनुसार संप D का न,शा ऑनलाइन आईडी संGया 10115149

28.4.24 से बेसम’ट, Jाउंड, फ़Kट-, सेक’ड और थड- Mलोर का Kवीकृत है।

3. उDर संGया 2 के अनुसार।

4. &रकॉड- के अनसु ार कवड- ए&रया 90% है।

5. ऐसी कोई अनुम)त नह(cid:23)ं द(cid:23) गयी है।

6. उDर संGया 1 के अनसु ार।”

3. Being dissatisfied, the Appellant filed a First Appeal dated 25.10.2024.

The FAA vide its order dated 14.11.2024, upheld the reply of PIO.

4. Feeling aggrieved and dissatisfied, Appellant approached the Commission with the instant Second Appeal.

Attendance of the parties.

Appellant: Absent despite notice.

Respondent: Shri R. K. Rohilla, Assistant Engineer (Building)/APIO, Karol Bagh Zone, appeared in person.

5. Proof of having served a copy of Second Appeal/Complaint on Respondent while filing the same in CIC on 08.01.2025 is not available on record. The Respondent confirmed non-service. Thus, Regulation No. 10 of the Central Information Commission Management Regulations 2007 has not been complied with by the Appellant.

6. The Respondent while defending their case inter alia submitted that the PIO had filed detailed written submissions dated 24.08.2026 disclosing complete facts of the case and requested the Commission to place the same on record, copy of the same was sent to the Appellant. The relevant paras of the written submission are reproduced as under:

“With due respect, it is submitted that an RTI application was filed by Smt. Veena Kumari and addressed to the PIO, AO/KBZ and the same transfer/received vide letter No.AO/KBZ/2024/8436 dated 05.09.2024 to the undersigned under Section 6(3) of the RTI Act, 2005, with instructions to furnish the information sought under Question directly to the applicant.

The transferred RTI application was duly entered in the RTI Register with ID No. 657 dated 20.09.2024, and a detailed reply was provided by this office vide letter no. D-687/EE(B)/KBZ/2024 dated 18.10.2024, in accordance with Section
