Bhupendra Kumar Vasnikar – Appellant
Versus
Tata SIA Airlines Limited – Respondent
DC/387/CC/2025/11

Advocates:
For the Appellants/Petitioners: R. K. Bhavani
For the Respondents: Rubi Naz

Denial of boarding to a passenger holding a confirmed ticket, under the pretext of overbooking, constitutes a deficiency in service and unfair trade practice. The airline is liable to pay comprehensive compensation for financial loss and mental agony, irrespective of any standard industry refund policies.

Headnote:(A) Consumer Protection Act, 2019 - Section 35 - Deficiency in service - Denial of boarding - Complaint filed against airline for denying boarding to a passenger despite holding a confirmed ticket, resulting in financial loss and mental agony - Practice of 'overselling' or 'overbooking' is not a justification for unilateral cancellation of a confirmed ticket without providing alternative arrangements - Unfair trade practice established. (Paras 1, 13, 14, 15)

(B) Compensation - Assessment of damages - Physical, mental and financial trauma - Where a passenger is left stranded due to arbitrary cancellation of a confirmed ticket, and compelled to make private travel arrangements, the airline is liable to pay additional compensation beyond mere ticket refund to cover legitimate expenses and mental harassment. (Paras 13, 14, 15)

Facts of the case:
Four passengers held confirmed flight tickets for a return journey. Upon reporting to the airport, the airline denied boarding to one passenger while allowing the others, despite the ticket status being 'confirmed'. No prior notice was provided, and the airline failed to offer any alternative travel arrangements. The denied passenger was forced to book a new flight the following day at a higher cost, incurring additional expenses for accommodation and transport.

Findings of Court:
The court held that the denial of boarding to a passenger with a 'confirmed' status, without proper justification or arrangement for alternatives, constitutes both a deficiency in service and an unfair trade practice. The airline failed to provide a valid reason for the breach of contract, and the compensation provided as a percentage of the fare was found insufficient to cover the actual loss and mental trauma suffered by the passenger.

Issues: Whether the airline's act of denying boarding due to overbooking on a confirmed ticket constitutes a deficiency in service and unfair trade practice, and the extent of compensation the passenger is entitled to for the resulting economic and mental hardship.

Ratio Decidendi: An airline cannot cite industry norms like 'overbooking' as a shield to violate a contract with a passenger holding a confirmed ticket. Such unilateral cancellation without alternative support creates a clear liability to compensate the consumer for physical, mental, and financial distress.

Result: Complaint partially allowed. Airline directed to pay compensation of Rs.1,00,000 and litigation costs of Rs.10,000, failing which 7% interest per annum shall apply.
