3. The present petition under Article 227 of the Constitution of India has been filed impugning the order dated 16.02.2024 passed by the learned Sole Arbitrator in arbitration proceedings between the parties.
4. It is submitted that the evidence of CW-1 Mrs. N. Vijaylaxmi was conducted. She was cross examined and discharged by the learned Arbitrator on 29.11.2023 and the respondent herein was asked to submit his list of witnesses and affidavit of evidence of the witnesses to be examined, however, instead of furnishing the list for the evidence affidavit, respondent has moved an application under Section 24 of the Arbitration and Conciliation Act, seeking recall of CW-1 and for production of certain documents. It is submitted that the application was challenged by the petitioner, however, by the impugned order dated 16.02.2024, the learned Arbitrator allowed the application.
