ORDER

 

1. The present petition under Article 226/227 of the Constitution of India read with Section 482 of the Cr.P.C. seeks the following prayers: “i) Adjudicate upon the ambit and scope of SFIO, as well as delineate the ambit and scope of the said provisions being wholly unguided and prone to misuse;

  • ii) Pass an order calling for records and further quashing of complaint case no. 70/3 of 2014 pending adjudication before the Court of Addl. Chief Metropolitan Magistrate, Tis Hazari Courts, Delhi-54 in the matter of entitled as 'Serious Fraud Investigation Office (SFIO) Vs.
  • M/s. ABCINDYA Network Pvt. Ltd. & Ors.' iii) Pass an order calling for records and further quashing of FIR No. 12 of 2011 U/s 409/420/120B IPC and 3/4/5/6 Price, Chits and Money Circulation Act (PCMC Act), EOW and all proceedings emanating therefrom and;
  • iv) Any other relief that this Hon'ble Court may deem fit and appropriate in the facts and circumstances of the present case.”

 

 

2. Learned counsel appearing on behalf of the petitioner submits that vide order dated 19.12.2016, it has been recorded that prayer (iii) stands deleted.
