I.A. 4732/2024 in CS(OS) 1948/2015 1. The present application has been moved on behalf of defendant No.2 for the stay of proceedings recording of evidence before the Local Commissioner.

2. Learned counsel submits that the evidence of the investigating officer is being recorded wherein the investigation is still in progress.

Learned counsel submits that this shall prejudice the interest of the applicant. Learned counsel for the applicant also submits that the summoned witness Sub Registrar- 1998 is a contested witness.

3. The evidentry value of the evidence of the witness is to be assessed by the Court at the time of final adjudication. The learned counsel can also get its objection recorded as to the relevance or admissibility of the evidence. Such objections shall be decided in accordance with law. There is no purpose in staying the proceeding. Let the notice be issued.
