% 29.02.2024 I.A. 4850/2024 (u/O XXXIX Rules 1 & 2 r/w Section 151 of CPC, 1908)

1. By way present application, the applicant/plaintiff seeks ad interim ex parte injunction against the non-applicant/defendant thereby restraining the non-applicant/defendant, her agents, servants, authorized representatives, her immediate family members, assignees, nominees, etc., from raising or continuing to carry out any unauthorised construction, except in accordance with the permission or sanction from the Municipal Corporation of Delhi (MCD) during the pendency of the present Suit.

2. It is submitted on behalf of the applicant/plaintiff that MCD has already issued a Work Stop Notice dated 16.01.2024 and the same has been forwarded to the SHO concerned for compliance.

3. Issue notice.

4. On taking steps, let notice be served upon the non-applicant/defendant through counsel through ordinary and electronic modes, returnable on 13.03.2024.

5. In the interim, the Registry is directed to requisition a report from the MCD and the SHO concerned vis-a-vis., the states of the unauthorised construction and compliance of the Work Stop Notice dated 16.01.2024.
