ORDER

% 08.04.2024 CM APPL. 20956/2024

1. This is an application on behalf of the Petitioner for clarification/modification of the Order dated 30.10.2023. The said order reads as under:-

“Learned Counsel for the GNCTD, on instructions, states that the State will redress the grievances raised by the Petitioner in the present Writ Petition by releasing the balance 60% of the amount due and payble to the Petitioner under the Post Matric Scholarship for SC Students.
Statement of the learned Counsel for the GNCTD is taken on record. The Writ Petition is disposed of along with the pending applications, if any.
It is made clear that this Order may not be treated as a precedent.”

2. Learned Counsel for the State submits that there is an error in the said order. He submits that State was obliged to pay only 40% and 60% was to be paid by the Union of India.

3. Learned Counsel for Union of India submits that once the State has already committed to pay amount of 60%, Union of India stands discharged from paying the said amount. The said contention of learned Counsel for Respondent No.1 cannot be accepted. Let a reply be filed in the matter.

4. List on 07.05.2024.

5. It is made clear that it is expected that Union of India will not take advantage of an error in the order and shall fulfil its obligations before the next date of hearing.
