ORDER

1. The Petitioner has approached this Court with the following prayers:-

“(i) Issue a Writ of Certiorari or- any other appropriate writ, order or direction thereby quashing of impugned order dated 21.11.2023 passed by Respondent No.1 regarding suspension of registration certificate and direction of ceasing the operation of Eating House License No. Ethl /Dcplic/2023/329;

(ii) Issue a Writ of Certiorari or any other appropriate writ, order or direction thereby quashing of impugned order dated 05.02.2024 passed by respondent No.2 regarding suspension of Excise License No.

L17/2022/08132 and direction of sealing the Bar and Liqour Store and Stock of the petitioner.”

2. In view of the fact that an alternate efficacious remedy is available to the Petitioner to file an appeal under Section 72 of the Excise Act, 2009 and Regulation 23 of the Delhi Eating Houses Registration Regulations, 2023, liberty is granted to the Petitioner to avail of the appellate remedy.

3. The writ petition is disposed of along with pending application(s), if any.

4. It is made clear that this Court has not made any observation on the merits of the case.
