1. Issue notice. Notice may be served upon the defendants through learned counsel appearing on their behalf.
2. The challenge in this appeal is to an order of the learned Joint Registrar dated 07.03.2024 by which defendant No. 1 was permitted to file an application for condonation of delay in filing of the written statement, and the plaintiff was directed to file a replication to the written statement of defendant No. 1 in accordance with provisions of law. The proceedings are next listed before the learned Joint Registrar on 09.04.2024.
3. Mr. Nishant Datta, learned counsel for the appellant-plaintiff, submits that the proposed written statement of defendant No. 1 is much belated and no application for condonation of delay is maintainable. He also submits that the direction of learned Joint Registrar with regard to filing of the replication to the written statement of defendant No. 1 is pre- mature, in as much as, the written statement of defendant No. 1 has not yet been taken on record.
