Learned counsel for the defendants has submitted that a Preliminay

Decree was passed in this case on 10.04.2023 and RFA (OS)13/2023 was

preferred by the defendant No.2 against the said Preliminary Decree,

wherein the partis have arrived at a settlement which is recorded in the

Order dated 13.10.2023.

Pursuant to the settlement the terms and

conditions of which are recorded therein, it has been observed that in case

either party fails to abide by the terms of the Settlement, the parties shall be

at liberty to file appropriate proceedings in accordance with law including

Contempt of Court proceedings.

dispute survives for adjudication in the present suit. Therefore, this suit is

also disposed of in terms of the settlement as recorded in the Order of the

Division Bench dated 13.10.2023.
