The present Petition has been filed on behalf of the Petitioner impugning the order dated 12.08.2024 [hereinafter referred to as “Impugned Order”] passed by the learned ARC-02 (Central), Tis Hazari Courts, Delhi with respect to the premises i.e., private shop no. 40 (old) New No. 10, in property no. 1977, Ground Floor, Katra Lachhu Singh, H.C. Sen Road, Chandni Chowk, Delhi – 110006 measuring 8.6 X 6 sq. ft. as shown in red colour in the site plan [hereinafter referred to as “subject premises”]. By the Impugned Order, the leave to defend Application filed by the Petitioner has been dismissed as the learned Trial Court has found no triable issue in the matter.
4. The only issue that is raised by the learned Counsel for the Petitioner is on the availability of alternate suitable accommodation. It is the case of the Petitioner that there are three shops available on the first floor along with rest of area of the property bearing no. 1977 and also the second floor of the property bearing
