The present petition has been filed under Article 226 Constitution of
India, 1950 read with section 5 of the Provincial Insolvency Act, 1920
seeking direction to Respondent No.1 to appoint an Official Receiver under
Section 57 of the Provincial Insolvency Act.

Ld. counsel for the GNCTD submits that the Department of Law,
Justice and Legislative Affairs of the GNCTD has sought a clarification
from the Ministry of Corporate Affairs vide letter dated 2nd January, 2023
in respect of the appointment of official receivers.

the proceedings pending before ld. JSCC-ASCJ-GJ, South East District,
Saket Courts in the insolvency petition titled 'Naveen Kachru vs. Govt. of
NCT of Delhi & Ors.' being Insolvency No.2/2019 which shall proceed in
accordance with law.
