3. The present appeal under Clause X of the Letters Patent Appeal seeks to assail the order dated 19.10.2022, passed by the learned Single Judge in W.P.(C) 5227/2012. Vide the impugned order, the learned Single Judge has, while considering the appellant’s challenge to the learned Labour Court’s award dated 24.03.2012, has enhanced the compensation awarded to him in lieu of re-instatement by the Labour Court from Rs.1,00,000/- to Rs.10,00,000/-.

4. The appeal is accompanied by applications seeking condonation of delay of 12 days in filing and delay of 512 days in re-filing the appeal.

Learned Senior Counsel for the appellant submits that the impugned order has still not been implemented by the respondent.

5. Though, prima facie we are not satisfied with the explanation given by the appellant for this inordinate delay in re-filing the appeal, since learned Senior Counsel for the appellant prays for and is granted time to seek instructions as to whether the appellant is willing to give up his claim for re-instatement and confine the present appeal only to a prayer for enhancement of compensation, we are deferring hearing.
