Municipal authorities are responsible for enforcing building regulations and taking action against unauthorized constructions.

Headnote:

Fact of the Case:

The petitioner filed a petition alleging willful disobedience of an order passed by the Division Bench of the Delhi High Court, directing the Municipal Corporation of Delhi (MCD) to demolish illegal construction on the fourth floor of a property and take action against the unauthorized construction of a lift.

Finding of the Court:

The court noted that the MCD had issued a demolition order against the lift, which was later set aside. A subsequent demolition order was issued on October 19, 2023, but an appeal against it was filed before the Appellate Tribunal, MCD (ATMCD), which stayed the coercive steps.

Issues: Whether the MCD had complied with the Division Bench's order to demolish the unauthorized construction on the fourth floor of the property.

Ratio Decidendi: The court directed the respondents to file an Action Taken Report regarding the unauthorized construction on the fourth floor of the property within four weeks.

Final Decision: The court listed the matter for further hearing on May 2, 2024.
