3. This is a petition seeking quashing of summoning order dated 16.07.2022 and the proceedings in Complaint Case No. 4737 of 2021 under Section 138 of Negotiable Instruments Act, titled as ATS Business Services Pvt. Ltd. Vs. Ved Prakash Jain pending before the court of learned MM (NI ACT) Digital Court-01, South East, New Delhi.

4. It is stated by Mr. Tripathy, learned counsel for the petitioner that the complaint is predicated on Cheque bearing no.122664 dated 21.12.2020, drawn on IDBI, Ground Floor, Ocean Complex, P6, Sector-18, Noida, Uttar Pradesh-201301 for an amount of Rs.7,81,337/-

5. He states that the amount of Rs.7,81,337/- has already been paid by the petitioner on 06.04.2021. The said fact was brought to the notice of the learned MM, despite the same being duly argued before the learned MM notice under Section 251 of Cr.P.C . was framed.

6. For the said reasons, issue notice through all modes, including electronic, returnable on 11.07.2025.
