O R D E R

% 13.08.2024 CM APPL 46496/2024 (seeking exemption from filing certified copy of annexures)

1. Exemption is granted, subject to all just exceptions.

2. The Petitioner shall file legible and clearer copies of exempted documents, compliant with practice rules, before the next date of hearing.

3. Accordingly, the application stands disposed of.

CM APPL. 46495/2024 (for grant of Advocate interim, ex-parte stay) and W.P.(C) 11236/2024 4. At the outset, it is noticed that the allotment of the subject chamber No. 370 has been done in favour of Mr. Shakeel Ahmed, who is not impleaded as a party. Any order passed by this Court will certainly affect the rights of Mr. Shakeel Ahmed. Accordingly, the Petitioner states that he will implead Mr. Shakeel Ahmed as a party to the present petition. Let an amended memo of parties be filed within one week from today and a copy of this petition be also served on Mr. Shakeel Ahmed.

5. Petitioner No. 1, Mr. Abdus Samad, is the second allottee of chamber No. 243, who has requested for change of chamber to second slot of chamber No. 370. A request to this effect was made on 18th July, 2023 as well as on 20th March, 2024 along with the NOC from the co-allotee of chamber No. 370 (Petitioner No. 2)

6. The said representations were taken up by the Lawyers Chamber Allotment Committee, Saket Court, on 4th April, 2024, but no decision was taken and the matter was deferred. Apprehending allotment of the 2nd slot of chamber no.370 to any other applicant, Petitioner No.1 preferred petition bearing W.P no. 7929/2024 which was decided vide order dated 28th May, 2024 directing the Respondent to consider the application of Petitioner No.1 before taking any final decision regarding the allotment of second slot of Chamber No.370. Thereafter, on 4th June, 2024, another representation was made by Petitioner No.1 along with a copy of the order dated 28th May, 2024. Subsequently, the chamber was allotted to one Mr. Shakeel Ahmed.

7. It is contended that as on the date of Petitioner’s representation dated 4th April,2024 and the order dated 28th May, 2024 there was no request made by Mr. Shakeel Ahmed for allotment in chamber No. 370. Subsequently, such request by Mr. Ahmed has been entertained and through impugned decision dated 30th July, 2024, ignoring the Petitioner’s request, Mr. Shakeel Ahmed has been preferred and given second slot in chamber No. 370. It is submitted that chamber No. 370 is partitioned, and the second slot is presently sealed.

8. Considering the above noted facts, till the next date of hearing, the parties shall maintain status quo as on today.

9. List on 22nd August, 2024.

SANJEEV NARULA, J AUGUST 13, 2024 nk
