1. The present application has been filed for restoration of the present petition, which had been dismissed in default and for non-prosecution on 01st September, 2023.
2. Considering the submissions made in the present application, the same is allowed. The writ petition is restored to its original number. The application is disposed of.
3. Learned counsel appearing for respondent no.2 – Reserve Bank of India has brought to the notice of this court the judgment dated 02nd November, 2023 passed in W.P.(C) No. 3191/2022.
4. It is submitted that the present matter is squarely covered by the aforesaid judgment passed by the Division Bench of this court.
5. The present petition has been filed seeking to challenge the action of the respondent no.1 in declaring the petitioner’s account as ‘fraud’. It is the case of the petitioner that the said action is arbitrary and that the account of the petitioner has been declared as ‘fraud’ without affording any opportunity of being heard.
