1. The present writ petition assails the order dated 22nd July, 20241 passed by District Magistrate, District North-West, Kanjhawala, Delhi- 110081 in case no. 799/SC/DC/NW/2023 in an application filed by Respondent No. 2– Smt. Lata Lekhwani, under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007 and the Delhi Maintenance and Welfare of Parents and Senior Citizen (Amendment) Rules, 2016. By way of the Impugned Order, the Petitioner has been directed to vacate the property bearing Flat No. AN/2C, Shalimar Bagh, 1“ImpugnedOrder”
W.P.(C)10868/2024 Page1of4 Delhi-110088 within thirty days from the date of receipt of the Impugned Order.
2. Under the Delhi Maintenance and Welfare of Parents and Senior Citizen (Amendment) Rules, 2016, the Petitioner has a statutory remedy of preferring an appeal before the Divisional Commissioner against the Impugned Order. However, the Petitioner submits that on account of the current vacancy in the position of Divisional Commissioner, the statutory remedy of appeal against the Impugned Order cannot be effectively availed by them.
