3. This application has been filed under Section 389 Cr.P.C. on behalf of the Appellant Baishar Ali S/o Sh. Afsar Ali, seeking suspension of sentence till final disposal of the present appeal in case FIR No. 117/2017 registered under Section 21(c) of Narcotic Drugs and Psychotropic Substances Act, 1985 (‘NDPS Act’) at PS: Crime Branch. Appellant was convicted by the Trial Court vide judgment dated 01.10.2021 and was sentenced, vide order dated 30.10.2021 passed by learned Special Judge (NDPS), North East, Karkardooma Courts, Shahdara, Delhi, to rigorous imprisonment for 10 years and a fine of Rs.1,00,000/- alongwith a cost of Rs.10,000/- as legal expenses and in default of payment of fine and cost, to further undergo sentence for a period of 6 months.
