TEST.CAS. 18/2024 The matter has been received upon being released by the Co- ordinate Bench since the connected suit bearing CS (OS) No. 68/2024 titled Baljeet Kaur Kalra & Ors. vs. Harpreet Singh Kalra & Ors. is pending before this court.

2. By way of the present petition filed under section 276 of the Indian Succession Act 1925, the petitioner who is the son of the testator/Late Shri Anup Singh Kalra seeks grant of Letters Of Administration in respect of registered Will dated 06.04.2016 left by late Shri. Anup Singh Kalra, which Will was registered with the concerned Sub- Registrar of Assurances on the same date.

3. Respondents No. 2-5 are stated to be the other legal heirs of the deceased testator.

4. By way of the connected suit filed by some of the private respondents, they had inter-alia sought partition and cancellation of Conveyance Deed dated 25.08.2023.

5. Issue notice.

6. Mr. Nishant Goyal, learned counsel appears on behalf of respondent No. 1 and accepts notice.

7. Upon the petitioner taking steps, let notice be sent to respondents Nos.

2 to 5, by all permissible modes, returnable for the next date.

8. Notice be also issued to the concerned Sub-Divisional Magistrate to file a valuation report in respect of the properties set-out in the Schedule to the petition, before the next date.

9. Let requisite citation be issued in the prescribed form in ‘The Statesman’ (English), Delhi Edition and ‘Navbharat Times’ (Hindi), Delhi Edition.

10. List before the learned Joint Registrar for the above purpose on 05th April 2024, the date already fixed in the connected suit.

11. List before court on 16th May 2024, the date already fixed in the connected suit.
