BIJENDER SINGH KHOKHAR – Appellant
Versus
OLA FOODS (PISCES ESERVICES PVT LTD) – Respondent
CS(COMM) 770/2022
For the Appellants/Petitioners: Plaintiff-in-person
For the Respondents: Mr. Sagar Chandra, Ms. Ishani Chandra, Ms. Sanya Kapoor
The court allows a self-represented plaintiff a chance to substantiate claims of trademark use despite insufficient evidence.
Headnote:This case concerns an application under Section 124 of the Trade Marks Act, 1999 regarding the invalidity of the plaintiff's trademark due to non-use. The plaintiff, representing himself, failed to provide sufficient evidence of use of the mark 'BOWLSOME' over the last five years. The court found merit in allowing the plaintiff another opportunity to substantiate his claims with an additional reply. The order allows for the filing of further documents and sets a date for the next hearing.
