4. It is stated that the applicant was unable to engage a counsel. It is also stated that he was in judicial custody and therefore there was a delay of 128 days in filing the present appeal.

5. Accordingly, the present application stands allowed, the delay of 128 days in filing the present appeal stands condoned.
