CRL.M.C. 2103/2024

In cases where the parties have amicably settled their disputes and the complainant has no further claims, the court may exercise its discretion under Section 482 CrPC to quash the FIR and subsequent proceedings.

Headnote:

QUASHING OF FIR - SETTLEMENT - SECTION 482 CRPC - [SUBJECT] - The Delhi High Court quashed an FIR and subsequent proceedings under Section 482 CrPC after the parties amicably settled their disputes.

Fact of the Case:

The petitioners, employees of the complainant, were accused of forgery, breach of trust, and criminal conspiracy. The parties later reached a settlement, and the complainant no longer had any claims against the petitioners.

Finding of the Court:

The court noted that the petitioners had shown remorse and undertaken not to repeat their conduct. It also considered that the complainant had no objection to quashing the proceedings.

Issues: Whether the FIR and subsequent proceedings should be quashed in light of the settlement between the parties.

Ratio Decidendi: The court held that since the parties had settled their disputes and the complainant had no further claims against the petitioners, no useful purpose would be served by continuing the criminal proceedings. It also directed the petitioners to pay costs to the Delhi State Legal Services Authority for providing counseling/psychological support to POCSO victims.
