1. Qua CM APPL No. 39398/2023, learned counsel appearing on behalf of the petitioner submitted that the amount as directed vide order dated 3rd August, 2023 stands deposited on 14th September, 2023. It is further submitted that since the matter is pending consideration, the impugned order may be kept in abeyance.

2. Learned counsel appearing on behalf of the respondents, in view of order dated 3rd August, 2023 having been complied with, does not oppose the prayer made on behalf of the petitioner.

3. He further prayed for three weeks’ time to file counter affidavit. Let the same be filed within three weeks, as prayed. Rejoinder thereto, if any, be filed within two weeks thereafter.

4. Heard learned counsel appearing on behalf of the parties.

5. In view of the submission made on behalf of the petitioner that the amount as directed by the Predecessor Bench of this Court vide order dated 3rd August, 2023 stands deposited with no objection on behalf of the respondent, the Court is of the view that the order dated 3rd August, 2023 has been complied with, therefore, the impugned order is kept in abeyance till the next date of hearing.
