3. We have heard Mr. Praveen Kumar Singh, learned Counsel for the petitioner and Ms. Pratima N Lakra, learned CGSC for the respondents.

4. This writ petition is directed against charge sheet dated 1 July 2025 issued to the petitioner. The charge sheet contained the following two charges which are completely vague and bereft of any particulars:

“First Charge AN ACT PREJUDICIAL TO GOOD BSF Act 1968 ORDER AND DISCIPLINE OF THE Section -40 FORCE In that he, during the period March 2023 to June

2024 while being posted as Second-in- Command of 200 Bn BSF gave undue favour and preferential treatment to No. 214012176 Mahila/CT (GD) Nitu Sing of 200 Bn BSF, bypassing standard professional boundaries, thereby undermining the discipline of Battalion.

Second Charge AN ACT PREJUDICIAL TO GOOD BSF Act 1968 ORDER AND DISCIPLINE OF THE Section -40 FORCE In that he, during the period January 2023 to April 2024 while being posted as Second-in- Command of 200 Bn BSF engaged in unprofessional conduct by making frequent and prolonged conversations on mobile phone, even in odd hours, with No. 214012176 Mahila/CT (GD) Nitu Sing of 200 Battalion BSF.”

5. Besides, these two charges have been practically bodily lifted from an earlier charge sheet issued to the petitioner on 3 April 2025, which contained several charges, including these two.

6. Further proceedings consequent to charge sheet dated 3 April 2025 already stand stayed by a Division Bench of this Court by an order dated 15 July 2025.

7. Necessarily, therefore, the proceedings relating to the present charge sheet would also have to be stayed.

8. Issue notice to show cause as to why rule nisi be not issued.

9. Notice is accepted on behalf of the respondents by Ms. Pratima N Lakra, learned CGSC.

10. Counter affidavit, if any, may be filed within four weeks with advance copy to learned Counsel for the petitioner, who may file rejoinder thereto, if any, within four weeks thereof.

11. Re-notify on 29 January 2026 to be taken up along with W.P.(C) 7935/2025.
