1. Learned counsel appearing for the petitioner submits that as far as unauthorized construction on the first and second floors of the property is concerned, action has already been taken by the Municipal Corporation of Delhi (“MCD”).

2. He further submits that construction existing on the ground floor is protected under the National Capital Territory of Delhi Laws (Special Provisions) Second Act, 2011 (“Delhi Special Laws”).

3. At this stage, learned counsel appearing for the respondent-MCD submits that the MCD be granted liberty to carry out fresh inspection of the property, in order to assess the status of the property.
